1. Sponsor. The sponsor of the Auction is Sport Squad, Inc. (“Sponsor”).
2. Auction Period/Deadlines. The Auction begins on Tuesday, November 19, 2024 at 10:00 a.m. Eastern Standard Time (EST) and closes on Thursday November 21, 2024 at 11:59 p.m. EST (the “Auction Period”). All bids must be submitted by 11:59 p.m. EST,
3. Bidding Procedures. To enter the Auction, Bidders must create an account at
www.joola.com (“Website”) by providing their name, address, email address, and any other information required by Sponsor. A credit card must be placed on file before the Auction. To participate in bidding, each Bidder must agree to these Official Rules. By completing your account for the Auction, the Bidder understands, acknowledges and agrees with these Official Rules. Once an account is opened, during the Auction Period the Bidder may make bids though the Website for the Auctioned Item. Minimum bids are in increments of ten dollars ($10.00). Once a bid is made, the Bidder cannot withdraw the bid. By furnishing
an email address, Bidders agree to receive regular emails from Sponsor during the Auction Period and thereafter.
4. Eligibility Requirements. The Auction is only open to persons in the United States of America who: (i) are 18 years of age or older at the time of bidding in the Auction and (ii) own a computer or mobile device with Internet access and (iii) make legitimate bids during the Auction Period and (iv) fully comply with these Official Rules (collectively, “Bidders”). The Auction is not open to people: (a) under 18 years of age or (b) who are residents of foreign countries, or (c) who are officers, directors, or employees of Sponsor. Any false information provided within the context of the Auction by any Bidder concerning identity, postal address, telephone number, or non-compliance with these Rules or the like may result in
the immediate elimination of the Bidder from the Auction. By entering and bidding, Bidders agrees to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding on all matters pertaining to this Auction. Bidders understand and acknowledge that they are responsible for
all fees to access the Internet.
5. The Auctioned Item. The Auction is for a one (1) JOOLA Ben Johns Perseus 3 Alpha 16 mm Pickleball Paddle autographed by Kevin Durant (“Auctioned Item”) along with a certificate of authenticity. The fair market value of the Auctioned Item is estimated to be $600. The Auctioned Item has not been officially appraised. All sales are final. The Auctioned Item is not redeemable for cash. There are no exchanges for other items and the Auctioned Item is sold “As Is” without any warranties. A portion of the proceeds of the Auction will be donated to the MCPS Athletic Club.
6. Winning the Auction. The Bidder with the highest qualifying bid during the Auction Period will win the Auctioned Item. Payment for the Auctioned Item purchased by the winner will be made to the credit card on file. The winning Bidder will be notified by e-mail. Auction Item winners understand and agree that Sponsor may post the winner’s name on Sponsor’s Website. Sponsor will send the Auctioned Item to the winner within fourteen (14) days of the close of the Auction Period.
7. Winner’s Responsibilities. Winners are solely responsible for the reporting and payment of any tax liabilities incurred.
8. General Conditions. This Auction is subject to all applicable federal, state and local laws. By participating, Bidders agree to be bound by these Official Rules and the sole and absolute decisions of Sponsor and waive any right to claim ambiguity in the Auction or these Official Rules. By participating, Bidders and the Auction Item winner agree that the Sponsor, those involved in the development, production, implementation, and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and each of their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Auction, including entry and bidding in this Auction. By participating, Bidders and the Auction Item winner release, discharge, indemnify and hold harmless Sponsor and its owners, managers, officers, directors, employees, representatives and agents from and
against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the Auctioned Item or participation in this Auction. This Auction is governed and construed in accordance with the laws of the State of Maryland without regard to the conflicts of laws or principles thereof. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. By participating in this Auction, Bidders agree that the Maryland courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Auction and that exclusive venue for any legal action shall be brought in the Courts sitting in the State of Maryland.
9. Limitations of Liability. Sponsor is not responsible for typographical or other errors in the offer or administration of this Auction, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the Auction Item winner, or the distribution of the Auctioned Item. Each Bidder assumes all risks and hazards related to the Auction and Auctioned Item. Sponsor is not responsible and assumes no responsibility for late bids due to system errors or failures, or faulty transmissions or other telecommunications malfunctions resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmission failures, or for any problems or technical malfunction(s) of any telephone network or lines, computer on-line systems, servers or providers, computer or mobile device equipment, or any combination thereof, or other telecommunications malfunctions which may limit a Bidder’s ability to participate in the Auction. Sponsor may prohibit any Bidder from participating in the Auction or winning the Auctioned Item if, in Sponsor’s sole discretion, it determines that said Bidder is attempting to undermine the legitimate operation of the Auction
by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other Bidders or Sponsor’s representatives. Sponsor reserves the right to disqualify any individual who tampers with the auction process. Caution: Any attempt by an individual to deliberately undermine the legitimate operation of the Auction is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to notify the authorities and to seek damages from any such individual to the fullest extent of the law.
